Aptus Serviços Personalizados de Planejamento e Computação Ltda. (herein “Aptus”, “Aptus Technology” or “We”), CNPJ: 52.640.521/0001-07, is committed to protecting data and personal information which are shared by users of Aptus´ websites and Apps (Google and Apple Store).

This document clarifies the kind of user information that is collected and how such information is handled and used, protecting the users´ privacy according to Law 13.709/2018 (General Law of Data Protection).

Aptus acknowledges the importance of users´ privacy, therefore taking every possible precaution to safeguard it. This Privacy Policy (“Policy”) clarifies how users´ data and information are collected, used, shared and stored in our websites and services, offering a safe and comfortable experience during their use.

The acceptance of our Policy is set when the user signs up in our platform to enjoy our services, indicating they are aware and in full accordance with how We handle their data and information.

Should they disagree with this Policy, the user must not conclude the signing up process required to enjoy our services. Nevertheless, we kindly request an explanation of the reasons for the disagreement, so we can improve our Policy.

Privacy Policy and Use of Cookies

Definitions:

Personal Data: The information that identify a person, such as name, CPF (taxpayer identity card) nº, ID nº, photograph etc. According to the Brazilian legislation, information may or may not be sensitive.

Sensitive Personal Data: The information related to race, ethnicity, religious belief, political conviction, affiliation to unions or religious, philosophical and political organizations, as well as information related to health, sexual habits, genetics or biometrics when connected to the individual.

User: any individual who interacts with Aptus in situations when they have the possibility of making their personal data available, e.g., individuals browsing websites, portals, social networks, clients, employees, third parties or service providers, among others.

Cookies: Data files stored in your computer or mobile device through the web browser. These files allow a website to “remember” actions and preferences registered in the user´s name for a period of time. The use of cookies exists so the user does not need to reinsert their browsing preferences (such as language, source, viewing format etc.) every time they reenter a website. Cookies may be persisting cookies or session cookies.

Persisting Cookies: these cookies remain in the user´s computer even after they close a session or until they are excluded.

Session Cookies: These cookies expire when the user closes the browser.

Term of Consent: Document which collects a favorable manifestation regarding the treatment of personal data for specific purposes.

Personal Data Collection

Information provided by the user: we collect personal ID information such as name, phone number, e-mail address, workplace and job position – via filling out of downloadable forms as well as information about our products and services. Occasionally, the request for some information may be made through direct contact from Aptus via e-mail or phone call.

Browsing information on the website: When the user visits our website, a ‘cookie’ is inserted into their computer through the “Google Analytics” software, in order to identify the number of times they return to our website. Collected data include IP address, geographical location, reference source, visit duration and visited pages.

Contact history: Aptus stores data regarding all interactions with our users, such as content downloaded from our websites and e-mail interactions.

Access to App: When the user logs into one of our Apps, we collect ID information such as “login” and password.

LinkedIn Data: When the user logs into their LinkedIn account to access our forms, we may collect all the data made available by LinkedIn to our system.

Use of Personal Information

All data and information collected are treated with confidentiality and used only for the aforementioned and authorized purposes, aiming at the excellence in the services we provide, the customization or creation of new services, products and features, according to your interests and needs.

We use the user´s data for the following purposes:

–E-mail: used for sending materials or information requested by the user when filling out a form. It may also be used for sending Newsletters and other important communications. The user may cancel the subscription at any time.

– Download data: may be made public as survey or statistics data, without openly revealing any personal information of the user, unless expressly authorized.

– Aptus´ employees may occasionally contact user via e-mail or phone call for surveys or to present products and services.

– Sending of messages related to assistance or service, such as warnings, notifications and updates;

– Communication about products, services, promotions, news, updates, events and others subjects of interest to the user;

– Marketing directed according to personal preferences, interests and other information collected from the user;

– Customization of service to adjust it more and more to the preferences and interests of the users;

– For any purpose the user authorizes at the moment the data is collected;

– To fulfill legal obligations.

The occasional use of data for purposes not foreseen in this Privacy Policy shall only be made after previous authorization by the user.

Access to Users´ Personal Information

Only Aptus´ employees shall have access to users´ personal information – and within this group of people, only those with proper authorization. On occasion, should the insertion of information be made through actions performed in a partnership, those partners – when properly identified – shall have access to the information.

No personal information shall be made public.

All personal information are confidential and its use must follow the present Policy.

Aptus shall make every reasonable effort to ensure security in our Apps, systems and users´ personal information. Our servers are stored in several locations all over the world in order to ensure both security and stability, and they shall only be accessed through previously authorized communication channels.

All personal information shall be encrypted, as long as this does not make their use by Aptus impractical, and shall be stored up to the moment they are no longer needed or relevant to the ends described in this Policy, or for as long as they are necessary for the maintenance of Aptus´ rightful interests.

Aptus considers its users´ privacy extremely important and shall do everything within its reach and power to protect it. Nevertheless, there is no way to completely ensure that every personal data and information inserted by users in our platform is totally exempt from unauthorized access, especially if there is improper sharing of the necessary credentials to access them.

The user is solely responsible for keeping their password safe and the sharing of passwords with third parties is forbidden.

The user pledges to immediately notify Aptus – via secure means – about any unauthorized use of their account or any unauthorized access by third parties.

Sharing of Personal Information

By clicking on the buttons for sharing content through social network, the user shall post that content through their profile on the chosen social network. Aptus does not have access to the “login” and password information of users on those social networks, nor shall post content on behalf of the users without the users themselves performing that action.

Every data, information and content about the user shall be considered assets in negotiations Aptus may be a part of.

Aptus retains the right to include user data in the company´s assets should it be sold, acquired or merged with another entity. The user manifests its awareness and agreement with such a possibility.

Aptus retains the right to supply users’ data and information, including their interactions, if it is legally or sentenced by a court of Justice to do so, which is necessary for the company to conform to the country´s laws, or if the users themselves expressly authorize it to do so.

Required cookies:

These cookies are necessary so the website works properly and cannot be turned off in our systems. They are usually defined as answers to actions performed by the user after a request for services, such as defining privacy preferences, logging in or filling out forms.

Analytics: These cookies allow us to count visits and traffic sources, so we can measure and improve performance of our site through “Google Analytics”. They help us know which pages are more and less popular and see how visitors browse our website. All the information gathered by these cookies are aggregated and therefore anonymous. If the user does not allow these cookies, we shall not know when they visited our website. Disabled.

Advertising cookies: These cookies may be defined through our website or by advertising partners. They may be used by those companies to build a profile of your interests and show you relevant ads in sites such as Facebook.com, Instagram.com, LinkedIn.com and Youtube.com. They do not directly store personal information, but they are based on the unique ID of your browser and internet device. If the user does not allow these cookies, they will not have advertising directed to them. Disabled.

Canceling of subscription and alteration/exclusion of personal information

The user may opt out of receiving any kind of e-mail from Aptus.

In every e-mail sent by us there is always a link to cancel subscription at the bottom. By clicking on that link you will automatically be taken out of the mailing list.

It is important to mention that the subsequent filling out of any form will reinsert your e-mail into the mailing list. Therefore, the request for cancelation of a subscription may have to be redone, if it is your wish.

Every data collected will be excluded from our servers when requested by the user or when they are no longer necessary or relevant to the services we offer you, unless there is any other reason for its storage, such as an occasional legal obligation of retention of data or a need to preserve such data for the protection of Aptus´ rights.

To alter their personal information or to exclude them from our database, the user has to send an e-mail to comercial@aptus.com.br.

Changes in Privacy Policy

This Privacy Policy may be updated. Therefore, we recommend you to visit this page from time to time so you acknowledge any alterations. If there are relevant alterations that require new authorizations from you, we will make the new privacy policy public.

Before using information for any purposes other than those determined in this Privacy Policy, we will request your authorization.

Applicable Law

This document is ruled and must be interpreted according to the Brazilian laws.

The court of the district circuit of Campinas, São Paulo, is selected as competent to solve any matters related to the present document, with express renouncement from any other, even if more privileged.
